TERMS OF SERVICE
Set out below are the terms of service for DevCounters.Com. Please take
some time to read through them. If there is anything you are unclear about,
don't hesitate to contact us.
1. DEFINITIONS
a) The SERVICE refers to the features that DevCounters.Com offers.
This includes but is not limited to the tracking of downloads and retention
and display of the collected information.
b) The USER refers to you, and anyone who will be making use of the your
account(s) here at the SERVICE.
2. YOUR RIGHTS
a) USER is allowed to access their account and set up as many counters
as they like within reasonable limits.
b) USER may not try and work around displaying the advertising page; any
deliberate attempt to do so that is discovered may lead to instant account
termination.
c) USER may not deliberately overload the service by spamming it with
download requests.
d) USER agrees not to make use of the SERVICE improperly, or use any of
its features to assist in any form of crime.
e) USER accepts that DevCounters.Com staff, will not
be liable to any costs that any downtime of the service may result in.
The SERVICE is provided AS IS and without any form of warranty, whether
implied of otherwise.
3. ACCEPTABLE DOWNLOADS
a) USER may not use the SERVICE to count downloads that promote illegal
activity or potentially harmful or hurtful activity. Examples include,
but are not limited to, hacking, nuking, breaking copyright laws, warez
and child pornography.
b) USER may not use the SERVICE to count downloads of adult content.
4. LIMITATION OF LIABILITY
a) USER agrees that operators of DonwloadCounter.Com, cannot be held
responsible for any loss of data, disruption of business and any other
events arising from usage of this service that may cause unwanted financial
cost or non-monetary cost.
b) USER accepts that this limitation extends to any of employees or agents
of DevCounters.com.
5. BREACH OF AGREEMENT & ACCOUNT TERMINATION
a) DevCounters.Com reserves the right to terminate account of USER
if they believe it to be in breach of this agreement either:
i. Immediately, if it is believed that the breach was intentional.
ii. After 5 days of discovering the breach, if the USER fails to stop
breaching these conditions or if the USER does not respond or attempt
to do so satisfactorily.
b) All action that will be taken will be at the discretion of staff at
DevCounters.Com based up on the information they have.
c) Under no circumstances will USER be able to hold any employee of the
SERVICE or the SERVICE as a whole responsible for loss or other issues
arising from the deletion of account created by USER.
c) If USERs account has been deleted, USER may sign up for another one
provided it is used in agreement with this document.
e) DevCounters.Com reserve the right to delete USER account(s) and
suspend the service should the need arise.
f) DevCounters.Com reserves the right to deny any individual or organization
of an account, or to deny access to the service to any individual or organization
on a temporary or permanent basis.
6. PRIVACY
a) DevCounters.Com and its staff will protect the privacy of the USER
to the level set out in our Privacy Policy to the best of our ability.
Information submitted by USER for private use will never be sold or given
away to any third parties.
b) DevCounters.Com reserve the right to give out any details of USER
submitted to us for purposes of law enforcement.
7. ALTERATIONS
a) DevCounters.Com reserves the right to add to and/or alter these
terms at any time.
b) DevCounters.Com agrees not to force USER to pay any fees for the
SERVICE unless USER should elect to do so.
8. CONTACT
a) We reserve the right to send out newsletters to the email address USER
has specified.
b) We reserve the right to contact the USER at the email address provided
should need arise.
c) USER agrees to provide a valid email address. Should USER fail to provide
an email address they can be contacted at DevCounters.Com staff reserve
the right to delete your account.
9. PAID SERVICE
a) USER may elect to pay for the SERVICE directly. This removes the advertising
from the intermediate page as well as making other options available to
you.
b) With the exception of section (2b) of this agreement USER agrees to
remain bound to this agreement after payment.
